Participant Agreement for the 2024 Aspire Talent Championships
This Participant Agreement, Waiver, Terms and Conditions, and Privacy Policy is designed to protect the interests of all participants and organizers of the 2024 Aspire Talent Championships By registering for the event, participants agree to adhere to all terms outlined in this agreement. Please read this document carefully as it affects your legal rights.
1. Participant Agreement
1.1. Eligibility and Registration
Eligibility: Participants must be at least 6 years old to compete in the championships. There are no upper age limits. Participants must be in good health and physically capable of performing the activities required. The competition is open to individuals from all over the world.
Registration: Participants must complete and submit the online registration form by October 14, 2024. Registration includes submitting personal details, category and apparatus selection, and payment of the non-refundable registration fee.
Consent for Minors: Minors must have a parent or legal guardian’s consent to participate. The consent form must be signed and submitted along with the registration form.
1.2. Code of Conduct
Respect and Professionalism: Participants must respect fellow participants, judges, staff, and spectators at all times. Professional conduct is expected throughout the event.
Prohibited Behavior: Any form of misconduct, including but not limited to violence, harassment, cheating, or vandalism, will result in immediate disqualification and potential legal action.
Dress Code: Participants must adhere to the costume guidelines specified in the competition rules. Inappropriate attire or failure to comply with dress code regulations may result in disqualification.
2. Waiver and Release of Liability
2.1. Assumption of Risk
Inherent Risks: Participants acknowledge that aerial arts activities involve inherent risks, including but not limited to physical injury, property damage, and death. These risks can arise from equipment failure, falls, missteps, or improper execution of maneuvers.
Voluntary Participation: By participating in the event, participants voluntarily assume all risks associated with their participation.
2.2. Release and Waiver
General Release: Participants release and forever discharge the event organizers, sponsors, volunteers, and affiliates from any and all liability, claims, demands, and causes of action arising out of participation in the event.
Specific Claims: This release includes any claims based on negligence, breach of warranty, or other legal theory, even if the organizers were aware of the risks.
2.3. Indemnification
Indemnity Clause: Participants agree to indemnify and hold harmless the event organizers, sponsors, volunteers, and affiliates from any claims, damages, losses, and expenses, including legal fees, arising from their participation in the event.
Scope of Indemnity: This includes any injury or damage to other participants, spectators, or third parties that results from the participant’s actions.
2.4. Medical Treatment
Authorization for Treatment: Participants authorize the event organizers to provide or obtain medical treatment in the event of injury or illness during the event.
Responsibility for Costs: Participants agree to cover any medical costs incurred as a result of such treatment, including emergency transportation, hospitalization, surgery, and follow-up care.
Insurance Requirement: Participants confirm that they have their own health and accident insurance to cover any potential injuries or medical expenses.
3. Terms and Conditions
3.1. Equipment and Safety
Provided Equipment: The event will provide aerial hammocks, silks, poles, ropes, and straps. All equipment will be inspected and certified for safety.
Personal Equipment: Participants may use their own equipment but must submit it for safety inspection prior to the event. Equipment must include necessary hardware such as carabiners and swivels.
Safety Guidelines: Participants must adhere to all safety guidelines provided by the event organizers. Failure to comply may result in disqualification.
3.2. Performance Guidelines
Schedule Adherence: Participants must follow the event schedule and attend all required rehearsals and warm-up sessions.
Costume and Music Approval: Costumes and music must meet the competition’s standards and be pre-approved by the organizers. Costumes should not be provocative or offensive, and music should be family-friendly.
Prohibited Items: The use of unauthorized props, hazardous materials (e.g., fire, water), or performance elements that pose a safety risk is prohibited.
3.3. Judging and Scoring
Judges’ Decisions: All decisions made by the judges are final and not subject to appeal.
Scoring Criteria: Performances will be judged based on execution, technical difficulty, artistic presentation, and adherence to guidelines.
No Communication: Participants are prohibited from communicating with judges regarding their performance scores before, during, or after the competition.
3.4. Disqualification
Grounds for Disqualification: Violation of any rules, misconduct, or failure to adhere to the code of conduct may result in immediate disqualification.
No Refunds: Disqualified participants will not be entitled to a refund of any fees paid.
4. Privacy Policy
4.1. Data Collection
Personal Information: The event organizers will collect personal information, including name, contact details, and health information, for the purpose of managing the event.
Secure Storage: This information will be securely stored and used solely for event-related purposes.
4.2. Consent
Participant Consent: By registering for the event, participants consent to the collection and use of their personal information as described in this policy.
Access and Correction: Participants have the right to access and request correction of their personal information at any time.
4.3. Photography and Videography
Media Consent: Participants consent to being photographed and recorded during the event. These images and recordings may be used for promotional purposes, including social media, marketing materials, and event highlights.
Usage Rights: Participants waive any rights to compensation or ownership of these images and recordings.
4.4. Third-Party Sharing
No Unauthorized Sharing: Personal information will not be shared with third parties without the participant’s consent, except as required by law.
Legal Compliance: The event organizers will comply with all applicable data protection laws and regulations.
5. Final Provisions
5.1. Governing Law
Jurisdiction: This agreement shall be governed by the laws of Thailand. Any disputes arising from this agreement will be resolved in the courts of Thailand.
5.2. Severability
Validity of Provisions: If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will remain in full effect.
5.3. Entire Agreement
Supersession of Previous Agreements: This agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings.
5.4. Amendments
Right to Amend: The event organizers reserve the right to amend this agreement at any time. Participants will be notified of any changes, and continued participation in the event signifies acceptance of the amended terms.

Appendix A: Detailed Assumption of Risk
Understanding the Risks: Participants acknowledge that aerial arts involve strenuous physical activity, which can lead to serious injuries. They accept that despite safety measures, accidents can occur.
Specific Risks: These include but are not limited to falls from height, cuts and bruises,
muscle strains, joint dislocations, fractures, and other injuries related to the use of aerial apparatus.
Appendix B: Detailed Indemnification
Scope of Indemnity: Participants agree to indemnify the event organizers against any claims made by third parties as a result of the participant’s actions during the event.
Duration of Indemnity: This indemnity remains in effect even after the event has concluded.
Appendix C: Privacy and Data Protection
Data Security: Detailed measures on how participants’ data will be securely stored and who will have access to it.
Data Retention: Information on how long participants’ data will be retained and the process for securely disposing of it.
